Terms of Service

These Terms govern your use of the Klub appointment-booking platform and websites (the “Service”), operated by Acme Software LLC (“Klub”, “we”, “us”). By using the Service you agree to these Terms.

1. The Service

Klub provides software that lets beauty, wellness and service businesses (“Salons”) publish availability, take online bookings, and manage appointments, clients and messaging. Klub facilitates bookings between Salons and their customers; the Salon, not Klub, provides the actual services booked.

2. Accounts and eligibility

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to create a Salon account.

3. Acceptable use

  • Do not use the Service to send unsolicited bulk messages, spam, or any unlawful, deceptive or harmful content.
  • Only contact customers for legitimate, transactional purposes relating to their appointments, and only where you have a lawful basis to do so.
  • Do not attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service or other users’ data.
  • Comply with all applicable laws, including data-protection and consumer-protection laws.

4. Bookings, payments and cancellations

Each Salon sets its own services, prices, availability, deposit and cancellation policies. Any payment, refund, no-show or cancellation terms are a matter between the customer and the Salon. Where card payments are offered, they are processed by a third-party payment provider subject to that provider’s terms.

5. Subscription and fees

Access to certain features may require a paid subscription. Fees, billing cycles and any applicable taxes are described at the time of purchase. Unless stated otherwise, fees are non-refundable except as required by law.

6. Your content and data

You retain ownership of the data you put into the Service. You grant us the limited rights needed to host and process that data to provide the Service, as described in our Privacy Policy. Salons are responsible for having a lawful basis to collect and process their customers’ personal data.

7. Intellectual property

The Service, including its software, design and branding, is owned by Acme Software LLC and its licensors and is protected by intellectual-property laws. These Terms do not grant you any right in our intellectual property except the limited right to use the Service.

8. Third-party services

The Service relies on third-party providers (for example for messaging, email, hosting and payments). We are not responsible for the availability or acts of those providers, and their terms may also apply.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that messages will always be delivered by third-party carriers.

10. Limitation of liability

To the maximum extent permitted by law, Acme Software LLC will not be liable for indirect, incidental or consequential damages, or for lost profits or data. Our total liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully. On termination you may request export of your data as described in the Privacy Policy.

12. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory local consumer-protection law applies to you.

13. Changes

We may update these Terms from time to time. Material changes will be posted here with an updated date; continued use of the Service means you accept the revised Terms.
